RTDS PROCESS
Retainer for Full RTDS Process
Retainer Amount: $1,500 - $2,500
This covers the entire process from initial consultation to resolution through the Residential Tenancy Dispute Resolution Service (RTDS).
Breakdown of Fees for Each Step in the RTDS Process
- Initial Consultation and Case Assessment: $150 - $300
Discuss the issue, assess the case, and provide initial advice. - Document Preparation: $300 - $500
Preparing necessary documents, such as applications and evidence submissions. - Filing RTDS Application: $100 - $200
Filing the application and ensuring all paperwork is correctly submitted. - Serving Documents: $100 - $150
Serving documents to the opposing party, including costs for process serving if needed. - Preparation for Hearing: $400 - $600
Preparing arguments, gathering evidence, and organizing witnesses. - Representation at RTDS Hearing: $500 - $700

RETAINER FOR COURT PROCESS

This covers taking the matter through the court system, which typically involves more time and complexity compared to the RTDS process.

Initial Consultation and Case Assessment: $150 - $300
Pleadings and Document Preparation: $600 - $800
Drafting pleadings, affidavits, and other court documents.
Filing Court Documents: $150 - $250
Including filing fees and administrative tasks.
Discovery and Evidence Gathering: $500 - $700
Conducting discovery and organizing evidence for court.
Pre-Trial Preparation: $700 - $1,000
Preparing for trial, including witness preparation and strategy development.
Court Representation: $1,000 - $1,500 per day
Representing the client in court, including trial appearances and motions.
Post-Trial Follow-Up and Appeals: $300 - $500

DOCUMENT ASSISTANCE FEES
Application for Residential Tenancy Dispute Resolution Service (RTDRS): $100 - $150
Assistance in completing and submitting the application form correctly.
Landlord’s Notice to End Tenancy: $75 - $125
Preparing and serving notices such as the 14-day notice for breach or non-payment.
Tenant’s Notice of Objection: $75 - $125
Assisting tenants in preparing a notice of objection to a landlord's notice.
Evidence Submission Form: $150 - $200
Organizing and preparing evidence submissions for the RTDS hearing.
Affidavit of Service: $50 - $100
Preparing the affidavit of service to prove that documents were properly served.
Request for Correction or Clarification of an Order: $100 - $150
Assistance with forms requesting changes or clarifications to RTDS orders.
Request to Reschedule a Hearing: $75 - $125
Preparing and submitting a request to change the hearing date.
COMMUNICATIONS UNBUNDLED FEES LIST
Demand Letter for Compliance: $100 - $200
Drafting and sending a formal demand letter to enforce compliance with a tenancy agreement or RTDS order.
Notice of Default: $75 - $125
Preparing and sending a notice of default when a party fails to comply with a tenancy obligation or order.
Communication with Enforcement Agencies: $150 - $250
Liaising with enforcement agencies, such as the Sheriff's Office, to facilitate the enforcement of an order.
Negotiation and Settlement Communications: $200 - $350
Engaging in written communication or negotiation with the opposing party to reach a settlement or enforce an agreement.
Follow-Up on Compliance: $100 - $150
Sending follow-up correspondence to ensure ongoing compliance with an order or settlement agreement.
MEDIATION
Family Law Mediation
1/2 day on all issues If more than 1 issue $400.00 (conducted virtually or in-person).
Neighbour Disputes
$300 for 1/2 day virtual or in person.
Roommate Disputes
$300 for 1/2 day virtual or in person or $100 for 1 hour virtually or in person.
Landlord Tenant mediation
$150 for 1 hour virtually or in person.
All mediations are subject to a mediation agreement. All parties who have signed a mediation agreement may have 1 Free half hour process telephone call with the mediator to outline the issues. Half-day mediations go from 9am-12pm or 1pm to 3 pm. Standard procedure is that each party pays 1/2 the mediation fee, however as circumstances widely vary either person may pay in full also. Please note: this service is only offered to non-clients, and if the matter proceeds to litigation after, both parties would have to hire a different lawyer to avoid conflict of interest.
